TERMS & CONDITIONS 

Acceptance and Agreement to These Terms 

These Terms and Conditions are an agreement between you (“The Lessee”) and Orbis Playland (“we”, “us”, “The  Lessor”). They govern your access to and use of our website. Every time you access our website and use its services,  you have agreed to be bound by these Terms and Conditions. 

The Lessee hereby acknowledges that they have read and understood the Terms and Conditions of Hire and  operating procedures of the soft play units as outlined in this rental agreement. By proceeding with the booking, the  Lessee accepts all terms of this rental agreement. 

Changes to these terms 

These Terms and Conditions are subject to change from time to time. It is your responsibility to review them for any  changes. The revised Terms and Conditions still indicate your acceptance and agreement to be bound by them when  utilising our website. 

Ownership; Copyright 

The website (www.orbisplayland.com.au) and its content that includes but not limited to: photos, images, videos,  other promotional material is the property of Orbis Playland, and is protected by Australian and international  copyright, trademark and other laws. Your use of the Website does not transfer to you any ownership or other rights  in the Website or its content. 

The website is not to be used for unlawful purposes or for personal gain. Hence, its contents are not to be copied,  reproduced, modified or redistributed in any way without the initial consent of Orbis Playland. 

You are not permitted to sublet or sell soft play products provided by Orbis Playland to any other party; you are  solely responsible for the ownership, care and maintenance of the products during the hire period (see section ‘Title  To’ for further information).



  1. Rental Policy 

When you complete your online quote and are satisfied with the price, you can complete the online  booking/purchase and pay your rental fee through a bank-transfer/direct deposit. See ‘Deposit and Reservation’ for  more information on costs. 

Note that the hire costs associated with each soft play equipment displayed on the website do not include any  delivery fees (see ‘Delivery Policy’ for more information). 

  1. Deposit and Reservation 

At the time of your booking, a 50% deposit along with a signed contract will be required to secure your requested  date. The remaining balance will be due fourteen (14) days prior to your event and will be charged to the credit card  we have on your order information. Failure to pay the balance will result in cancellation of the event and a  cancellation fee totaling to 30% of your package total. If your booking is less than fourteen days prior to the party  date, the full amount will be due at the time of booking. 

  1. Cancellations and Refunds 

Please be aware that once the contract is signed, and your event date is scheduled, all other clients have been  refused your specific rentals and services for your event date, and thus the 50% deposit is non-refundable. 

All services may be canceled if received in writing via paper or email no later than three (3) weeks before the event.  A credit in the amount of the deposit will remain on file if the event is postponed. Otherwise, no refunds will be  processed for change of mind, error in booking or unforeseen circumstances that are out of our control. 

  1. Security Deposit

This is a bond that you will be required to give to Orbis Playland to cover any damage done to equipment, or excessive cleaning as a result of untidiness. This deposit becomes non-refundable in this case. Return of your bond  will be returned via the same method of payment as your booking within 1-2 business days after your event.  

  1. Weather Conditions

If you are hosting an outdoor event you assume all weather-related risks. However, should it rain, storm, become  windy, or too hot to operate, Orbis Playland will work with you on a solution. 

If you are not able to hold your event indoors, a refund will be given on your deposit and payment. Orbis Playland  will rebook your event upon availability on our schedule. 

Note that once Orbis Playland is set up and your event time has started, a refund WILL NOT be issued. 

  1. General Rules 

During your hire period, the following rules must be adhered to: 

  • Adult supervision is required at ALL times. A person over the age of 18 MUST be present. The safety of children is your responsibility.
  • All children’s shoes must be taken off and socks must be on (this includes supervising adults). No high heels, or sharp objects as they create irreparable holes in our concertina mats). No toys, jewellery, or other foreign objects are permitted on soft play equipment.
  • Strictly no food, snacks or drinks are to be consumed within the play area.
  • Strictly NO pets, sand, mud, dirt, face paint, pens, texters, dye, glitter, confetti and streamers, or other adhesive substances to be on or near the equipment as they will leave a permanent stain. Additional cleaning fees will apply, and any stains deemed severe will incur a damage or replacement fee. Summersaults, or rough play is not allowed. 
  • Once soft play is set up for use, it must not be moved or rearranged.
  • Ensure the area of set up is free of hazards.
  • Pets must be restrained or removed from the play area during the duration of hire. Additional cleaning or damage fee will apply if pets have been suspected to be on the equipment.

These rules will also be communicated to you when you sign the soft play agreement form prior to soft play delivery  and setup. 

  1. Maintenance and General Instructions 

Part of the soft play agreement requires you to maintain the soft play equipment. This means that during setup,  play, and pack up, the soft play equipment is in the same condition (ordinary wear and tear accepted). To reduce the  number of germs and therefore the spread of disease or illness, you must immediately disinfect any equipment that  comes into contact with the following: leaked and soiled diapers, vomit, blood, mucus, or any other bodily fluids. A  disinfectant will be provided by Orbis Playland to ensure equipment can be properly sterilised and is safe to use for  all. Soft play that is stained with anything, or damaged in any way upon collection will incur a cleaning and/or  damaging fee. 

If soft play equipment is damaged in a way that would cause injury, immediately remove children and contact Orbis  Playland. The soft play rules plaque must always be displayed so that all participants (children and supervising  adults) are aware of the rules. 

You must be present onsite from the time agreed for equipment setup and safety inductions. For the duration of the  hire, you must remain present onsite until the return, cleaning and collection of equipment by Orbis Playland staff.  During pack up and collection, should the soft play equipment be damaged or soiled in any way that may be deemed  unsustainable, a cleaning or repair surcharge will apply to ensure the equipment is in a hireable state for another  rental period. 

  1. Rearrangements and Attachments

You must not move, rearrange, or attach anything extra onto the soft play equipment without consent of Orbis  Playland. Should you require additional equipment or attachments, please make a request to Orbis Playland at the  beginning of the hire period. Orbis Playland staff will safely rearrange all soft play equipment should you require it. 

  1. Damages

On the day of the event, you will be instructed about the safe operational requirements of the soft play equipment  and must have read, understood and signed all the Terms & Conditions listed in the Soft Play Agreement. 

You agree to observe all safety precautions listed in our Soft Play Agreement and on the safety plaques provided  with our soft play equipment. It is mandatory that you have the plaque erected in front of the soft play setup area  and ensure that it is visible to all. 

Should our soft play equipment sustain damage during the hire period, you agree to pay in full the replacement cost,  including labour, for all damages to the soft play equipment. Should the soft play equipment be lost, stolen, or  damaged beyond repair, you agree to pay up to $3000.00 (three thousand dollars and zero cents) in reimbursement. 

  1. Title To and Ownership 

Orbis Playland is the sole owner of the soft play equipment supplied at all times. As the lessee, you agree to strictly  keep the soft play equipment in your possession at all times and must not sublet, sell, depose of, or remove the soft  play equipment from the agreed location and use it elsewhere. During the hire period which includes the setup and  pack up times, you are responsible for the maintenance, care, safety of the soft play equipment. 

Any breach of this contract will result in additional labour costs to retrieve, locate, repair any lost or stolen  equipment. Soft play that is deemed irreparable will incur a payout of up to $3000.00 (three thousand dollars and  zero cents). 

  1. Waiver and Release of Liability 

The Lessee shall be fully in charge and responsible of the safe operation of soft play equipment during use, as well as  its return in good condition upon collection. You understand and acknowledge that soft play entails both known and  unknown risks including, but not limited to: physical injury from falling, slipping, crashing or colliding, emotional  injury, paralysis, distress, damage or death to any participant. 

The Lessee agrees to indemnify and hold Orbis Playland unaccountable for any and all claims, actions, suits,  proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to: reasonable attorney’s fees  and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from  the use of the leased equipment. This includes, but is not limited to: the manufacture, selection, delivery,  possession, use, operation, or return of the equipment. 

The Lessee hereby releases and holds Orbis Playland unaccountable for injuries or damages incurred as a result of  the use of the soft play equipment. 

Orbis Playland cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, natural  disasters, or any other unforeseen occurrences that are beyond one’s control or knowledge. The Lessee also agrees  to indemnify and hold Orbis Playland unaccountable for any loss, damage, theft or destruction of the soft play  equipment during the term of the rental and any extensions thereof.
